1.1. These general conditions govern access to, navigation of and use of the Padel Cubelles application (hereinafter, "the Application"), together with the liabilities arising from such use.
1.2. Accessing the Application and creating an account confer the status of user and imply full and unreserved acceptance of every clause of these conditions in the version published at the time of access. Anyone who does not accept these conditions must refrain from using the Application.
2.1. Padel Cubelles is a private, non-profit project with no corporate form and no associated commercial activity.
2.2. The contact address for all purposes under these conditions is info@padelcubelles.com.
3.1. The Application is a free tool that allows people interested in padel in Cubelles to contact one another in order to arrange games.
3.2. The operator is not a sports club, does not organise sporting activities, does not provide coaching, and has no legal, corporate or collaborative relationship of any kind with the Poliesportiu Municipal de Cubelles or with any other sports facility.
3.3. The Application does no more than facilitate contact between users. Organising the game, travelling to it and dealing with the sports facility are matters for the users alone.
4.1. Use of the Application is restricted to persons aged 18 or over. The creation of accounts by minors is prohibited.
4.2. The user undertakes to provide accurate information on registration and to keep it up to date.
4.3. The user is responsible for safeguarding their access credentials and for all activity carried out from their account.
4.4. Where the operator becomes aware that an account belongs to a minor, the account will be closed and the associated data deleted.
5.1. The Application does not book courts and does not handle bookings of any kind. Bookings must be requested directly from the Poliesportiu Municipal by whatever means it specifies.
5.2. The court status shown in the Application is entered by hand by the users themselves and does not come from the sports facility, and may therefore be incomplete, incorrect or out of date.
5.3. The user must confirm availability and the booking directly with the sports facility before travelling. The operator is not liable for loss arising from reliance on information published by other users.
6.1. Access to and use of the Application are free of charge. No sum is charged to users and no financial transaction takes place through the Application.
6.2. The court fee and any other expense are paid directly at the sports facility and are no concern of the operator.
7.1. The user undertakes to use the Application in accordance with the law, with these conditions and with the requirements of good faith.
7.2. It is prohibited in particular to impersonate third parties, to publish insulting, discriminatory or threatening content or content contrary to the dignity of the person, to harass other users, and to use the Application for commercial or advertising purposes.
7.3. The user is answerable, to the operator and to third parties, for the content they publish and for the consequences of the meetings they arrange through the Application.
8.1. Messages published in a game's chat are visible to the other players in that game and constitute the record of how the game was organised.
8.2. The operator does not review published content in advance, without prejudice to its power to remove content that is contrary to these conditions or to applicable law.
9.1. The Application allows a user to invite other people by supplying their email address, and to add guest players by supplying their name.
9.2. In supplying a third party's data, the user represents that they have informed that person of the processing and have their consent, and is answerable for the accuracy and lawfulness of the data supplied.
9.3. A person whose data has been supplied in this way may request its deletion at info@padelcubelles.com, and that request will be acted on without notifying the user who supplied it.
10.1. The operator may suspend or close the account of a user who breaches these conditions, notifying the person concerned where that is possible.
10.2. Given that the service is free of charge, suspension or closure gives rise to no right to compensation.
11.1. The user may close their account at any time from the settings section of the Application, without having to give reasons.
11.2. Closing the account entails deletion of the user's identifying data on the terms described in the privacy policy. Games already played are retained without that data, because they belong to the other participants as well.
12.1. The Application is provided "as is" and subject to availability. The operator does not warrant continuous availability of the service, the absence of errors, or the permanent retention of content.
12.2. The operator may interrupt, modify or permanently discontinue the service, endeavouring to give reasonable notice.
12.3. The operator is not liable for the conduct of users, for harm occurring in connection with meetings arranged through the Application, or for the accuracy of information entered by users.
12.4. The above limitations do not exclude liability that cannot lawfully be excluded, in particular liability under consumer protection legislation.
13.1. The processing of users' personal data is governed by the Application's privacy policy, which forms an integral part of these conditions.
14.1. The operator may amend these conditions. The version published in the Application applies, together with its stated date of last update.
14.2. Substantial changes will be notified to registered users by email.
15.1. These conditions are governed by Spanish law.
15.2. Any dispute will be submitted to the courts having jurisdiction under Spanish law.
15.3. The foregoing is without prejudice to any forum mandatorily available to users who are consumers.
